Legal notice and privacy policy

1. Who is responsible

This website and Automatitzut’s channels (email, the website chat and Instagram @automatitzut) are run by its two founders, who are the controllers of your personal data:

2. What data we process and why

We only process the data you give us or that comes from your conversation with us. We do not buy databases and we do not sell your data.

Instagram messages

• Data: your Instagram name and username, the messages you send us, and any details you choose to share in the conversation (for example, email, phone, company or what you need).
• Why: to reply to your messages and, if you ask us to or leave your contact details, to tell you about our services and follow up on your enquiry.
• How: some replies are given by an automated AI assistant. Joan or Adrià can read the conversation and reply in person at any time. The assistant does not make decisions that have legal effects on you.

Email and meetings

• Data: name, email, company, job title, phone and whatever you tell us in your messages or in the meeting.
• Why: to reply to you, arrange the free assessment, prepare a proposal and, if you become a client, manage the project.

Website chat and voice assistant

• Data: the conversation (text or voice) and, if you book an assessment, your name, email and chosen time.
• Why: to answer your enquiry and book the meeting in our calendar.
• Before it starts, the chat shows you a privacy notice that you must accept. Do not enter passwords, bank details or other people’s personal data.

Marketing communications

We will only send you marketing emails if you ask for them or give us your consent. You can unsubscribe at any time by replying to the email or writing to hola@automatitzut.com.

3. Legal basis

• Your request and steps taken before entering into a contract (Art. 6(1)(b) GDPR): when you write to us, ask for information or book an assessment.
• Your consent (Art. 6(1)(a)): when you give us your contact details so we can follow up, accept the website chat notice, or agree to receive communications. You can withdraw it whenever you like.
• Performance of a contract (Art. 6(1)(b)), if you become a client.
• Legal obligations (Art. 6(1)(c)), such as tax obligations, where applicable.

4. How long we keep your data

• Instagram messages: they stay in the Instagram inbox for as long as the conversation exists. If you ask us, we delete it on our side (see section 7).
• Contact details and sales follow-up (in our CRM): while there is mutual interest and for no more than 2 years after the last contact if you do not become a client.
• Website chat conversations: up to 90 days.
• Clients: for the duration of the relationship and afterwards for the periods required by law.

5. Who we share your data with

We do not share your data with third parties unless required by law. To operate, we use the following providers, which process data only on our behalf (data processors):

• Meta Platforms (Instagram): messaging.
• InstantDM: automated replies on Instagram.
• Anthropic (Claude) and n8n: artificial intelligence and automation of some replies and tasks.
• HubSpot: the CRM where we keep contacts and sales follow-up.
• Google (Google Workspace): email and calendar.
• ElevenLabs: the website chat and voice assistant.
• Netlify: website hosting.

Some of these providers are based in the United States or may access data from there. In those cases, the transfer is made with the safeguards provided for in the GDPR, such as the EU-US Data Privacy Framework or the standard contractual clauses approved by the European Commission.

6. Your rights

You can ask us at any time for:

• Access: to know what data we hold about you.
• Rectification: to correct inaccurate data.
• Erasure: to delete it.
• Objection and restriction: to stop using it, or to use it only for some purposes.
• Portability: to receive it in a format you can take elsewhere.
• Withdrawal of consent, without affecting what we did before.

Write to hola@automatitzut.com. We will reply within one month. If you believe we have not handled your request properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

7. How to ask us to delete your data

To have your data deleted, including your Instagram conversation with @automatitzut:

• Email hola@automatitzut.com with the subject “Delete my data”, or send us “Delete my data” as a direct message on Instagram.
• Tell us your Instagram username or the email you contacted us from, so we can find your data.
• We will delete your data from our tools (Instagram, CRM and automations) within 30 days and confirm it to you. We will only keep what the law requires us to keep.

You can also delete the conversation from your own Instagram app, although that only removes it on your side.

8. Cookies

This website does not use its own cookies, analytics cookies or advertising cookies. The fonts are hosted on this website, so they are not loaded from external services either.

The website chat is provided by ElevenLabs. If you use it, it may store in your browser the technical information strictly needed for the conversation to work. Because it is strictly necessary, it does not require prior consent.

9. Website terms of use

• The information on this website is for guidance only and is not a binding offer.
• The text, design and code of this website belong to Automatitzut. Other companies’ trademarks and logos belong to their owners and are shown only to indicate which tools we work with.
• We are not responsible for the content of external websites we link to.
• Our services are aimed at businesses and professionals. If you are under 14, please do not send us personal data.

10. Changes to this page

We may update this page, for example when we change providers or once the company is incorporated. The date at the top shows the latest version.
